Terms of Service

These terms are an agreement between you and Hangxiety App LLC (“Hangxiety,” “we,” “us”) covering the Hangxiety mobile app and hangxietyapp.com. By creating an account you accept them. If you do not accept them, do not use Hangxiety.

The most important thing on this page

Hangxiety is not an emergency service.

The SOS feature alerts the people you choose — your Safety Group and your emergency contacts. It does not contact 911, police, paramedics, campus security, or any other emergency responder. If you are in danger, call 911. Hangxiety cannot detect drink spiking, assault, or any other harm, and does not monitor for them.

Hangxiety is a tool for coordinating with people who already care about you. It is not a security service, a monitoring service, or a substitute for your own judgment. Never rely on it as your only safety plan.

Who can use it

You must be at least 18 years old, or the age of majority where you live, to create an account, and you confirm your date of birth when you sign up. Giving a false date of birth is a violation of these terms. Some features require a verified .edu email address.

Your account

  • Give accurate information and keep your password secure.
  • You are responsible for what happens under your account. Tell us promptly if you think someone else is using it.
  • One account per person. Do not impersonate anyone.

Location sharing

Location sharing is something you turn on. It runs only while you have an active Safety Group or Safe Walk, and you can pause or stop it at any time. By joining a group you are choosing to let the other members of that group see your location while it is active.

Only invite people you actually trust, and only join groups run by people you actually know. We cannot vouch for anyone else in a group.

Emergency contacts

When you add someone as an emergency contact, you confirm that you have their permission to give us their phone number and to text them on your behalf. Standard message rates may apply to them. Do not add anyone who would not expect to hear from you in an emergency, and never use the SOS feature to harass anyone.

Reviews, venues, and incident reports

You can rate venues, add venues, and submit incident reports. When you post content you keep ownership of it, and you grant us a non-exclusive, worldwide, royalty-free license to display and distribute it within the service — including in anonymized, aggregated safety indicators.

You agree that what you post will be truthful and first-hand. Do not:

  • Post anything false, defamatory, or written to damage a business you have a grudge against.
  • Name or identify individuals, including staff or other patrons.
  • Post anything harassing, hateful, or unlawful.
  • Submit reports about incidents you did not experience or witness.

Written reviews are reviewed before they appear publicly. We may edit, refuse, or remove any content, and we may suspend accounts that abuse these features. Safety information posted by other students is their opinion, not our verified finding — treat it accordingly.

Acceptable use

Do not:

  • Use Hangxiety to stalk, track, surveil, or intimidate anyone, including by pressuring someone to share their location.
  • Try to access another user’s data, probe our systems, or work around security controls.
  • Automate, scrape, overload, or resell the service, or send spam through it.
  • Fire test or false SOS alerts at people who have not agreed to it.

Using Hangxiety to monitor someone against their wishes is a serious violation and will get the account terminated.

Changes to the service

Hangxiety is actively developed. Features may change or be removed, notifications and messages may be delayed or fail to arrive, and data may occasionally be lost. Do not treat it as a reliable emergency system.

No warranty

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that any alert will be delivered, or that any safety information in the app is accurate.

Limitation of liability

To the fullest extent permitted by law, Hangxiety App LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service. This includes any harm arising from an alert that failed to send, arrived late, or was not acted upon, and any act of a third party.

Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.

Indemnity

You agree to indemnify and hold harmless Hangxiety App LLC from claims arising out of your content, your use of the service, or your violation of these terms or of anyone else’s rights.

Ending your use

You may delete your account at any time from within the app. We may suspend or terminate accounts that violate these terms or that create risk for other users. Sections that by their nature should survive termination — ownership, warranty disclaimers, liability limits, and indemnity — will survive.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Disputes will be brought in the state or federal courts located in La Plata County, Colorado, and you consent to that jurisdiction.

Changes

We may update these terms. If a change is material we will update the date above and notify you in the app. Continuing to use Hangxiety after a change means you accept the new terms.
